To renew an ordinary, year-round New York retail liquor license, submit the current renewal application, your renewal advisory, the correct payment, an original signed surety bond, and any required supporting documents. File at least seven calendar days before the current license expires. New York City on-premises licensees must also provide community-board notice and submit proof with the application. Starting early gives you time to correct a missing signature, defective bond, or notice problem before the expiration date. [1] [2]

A renewal reminder is not an extension, and a pending application does not automatically authorize continued alcohol sales. Continued operation under the State Administrative Procedure Act, commonly called “SAPA,” depends on a timely and sufficient application. This guide focuses on year-round retail renewals; manufacturers, wholesalers, seasonal licensees, and permit holders should use the separate forms applicable to their authorizations. [3] [4]

When must a New York liquor license be renewed?

Work backward from the expiration date on the existing license certificate. The SLA’s current retail application and published renewal advisories require filing at least seven calendar days before expiration. The advisories specify that a mailed renewal must be mailed and postmarked by that deadline. The rule is not seven business days and is not satisfied merely by preparing a packet or buying postage. Preserve evidence of mailing, postmark, and delivery. [1] [5]

For example, a year-round license expiring November 30, 2026 has a seven-day filing deadline of November 23. That is a last permissible filing date under the stated rule, not a sensible target for starting the process. An earlier submission leaves room to address defects before November 30.

The SLA says it sends renewal advisories approximately three months before expiration. Separately, Alcoholic Beverage Control Law § 109(2) requires the agency to provide renewal applications for licenses under §§ 64 and 64-a at least 60 days before expiration. Neither provision makes the license renew itself if a reminder goes missing. Keep an independent calendar and retrieve the advisory or contact the Renewal Unit promptly. [3] [6]

How long does a renewed license last?

Common retail terms are:

License category Usual term
Retail beer-only license, on-premises or off-premises Three years
Off-premises liquor store or wine store Three years
On-premises wine or liquor license Two years
Seasonal license Annual renewal for the applicable season

Advisory 2020-21 expressly excludes seasonal-license renewals from its seven-day deadline. Seasonal licensees should use the separate seasonal renewal application and arrange authorization for the next season before resuming licensed activities; the exception does not authorize sales outside the licensed season. [7]

These are general categories, not a substitute for the actual license class and advisory. Certain specialized classes have different terms. Use the existing certificate for the expiration being addressed and the advisory for the proposed new term. A three-year store renewal and a two-year restaurant renewal should not be budgeted or calendared as identical transactions. [3] [8]

What notice must a New York City licensee give?

For the on-premises license classes covered by ABC Law § 110-b(1)(b), a renewal in New York City requires notice to the community board for the premises. An ordinary off-premises store renewal does not trigger that provision, and routine renewals outside New York City are not included in it. A separate alteration, ownership transaction, or other application may raise its own notice requirements. [9]

Use the SLA’s current Standardized Notice Form, select renewal, and answer the renewal questions. Include the correct license ID, licensee name, trade name, premises, operating information, and principal’s certification. Compare the notice with the existing license record and the renewal application; inconsistent descriptions of entertainment, outdoor areas, or the business’s identity invite avoidable questions. [10]

Filing and approval have different notice deadlines

Current § 110-b requires notice before filing, no more than 270 days in advance, and proof of notice with the application. It prohibits the SLA from approving the application until 30 days have elapsed after notice. The statute does not currently require waiting 30 days after notice before filing. Some SLA renewal webpages and older instructions still describe that former sequence. The statutory distinction matters when expiration is approaching. [9]

As a practical scheduling measure, serve notice well ahead of filing and expiration whenever possible. If time is short, do not miss the seven-day renewal deadline merely to satisfy the older webpage’s prefiling wait. Serve valid notice, include the required proof, file promptly under the current statute, and address the application’s completeness and operating status with the Renewal Unit. Filing during the statutory approval waiting period is not itself a promise that the renewal will be approved before expiration.

Use an authorized service method

Permitted methods include certified mail with return receipt requested, overnight delivery with proof of mailing, and personal service. Email is available only where the municipality or board has elected in writing to accept it; an ordinary email to a board’s public address is not necessarily valid service. Retain the completed notice and the corresponding service evidence. For email, the statute calls for an acknowledgment reasonably identifying the applicant, or another form of proof accepted by the SLA. [9]

SLA Advisory 2022-32 explains acceptable evidence for the different service methods, including postal documentation, delivery-service receipts, and acknowledgment or affidavit evidence for personal delivery. Read that advisory’s older timing language subject to the current statute. The board may comment on the renewal, but its recommendation does not itself issue or extend the state license. [11] [9]

What belongs in the renewal packet?

Download a fresh application rather than reusing a form from the previous license term. The retail form reviewed for this article is revised August 11, 2026. Assemble:

  • The business’s renewal advisory and all pages of the completed application.
  • Payment of the advisory’s total, by check or money order payable to the New York State Liquor Authority.
  • The original surety bond, in the appropriate amount and signed by the licensee. The premises name and address must match the certificate, and the bond’s expiration must match the new expiration on the advisory.
  • NYC community-board notice and service proof, where required.
  • Applicable explanations, supporting records, and signatures, including a notice of appearance when an attorney or representative assisted. [1][12]

The current form requires information about premises control, the landlord even where the licensee owns the building, the method of operation, and existing conditions or stipulations. A closed location or a license in safekeeping requires the requested explanation and anticipated reopening information. Renewal does not authorize reopening a location that remains subject to a closure or other restriction. [1]

Make the signature section match the applicant. The form requires each partner’s execution for a partnership; a corporation, LLC, or LLP uses its authorized-principal section and lists the remaining principals. The entity certification includes its authority to do business and good standing. Do not use one person’s signature as a substitute for signatures the applicable section requires. [1]

Disclose required information without treating renewal as a change application

Read the arrest and conviction question carefully, including the people covered, the renewal period, the minor-traffic exception, and the “previously reported” option. Supply applicable disposition or pending-case documentation. A pending charge and a conviction are different facts; answering inaccurately can create a separate licensing problem. Can You Get a New York Liquor License With a Criminal Record? addresses criminal-history eligibility in greater detail. [1]

ABC Law § 110(4) requires a supplemental statement within ten days when facts required in the application change. That reporting obligation does not permit an owner to implement a transaction that separately requires advance approval, or to wait until renewal to disclose an earlier change. [13]

The August 2026 renewal form expressly says the renewal process cannot be used to make principal, physical-premises, trade-name, or method-of-operation changes; the appropriate change application is required. Although the general renewal webpage still suggests a trade-name change can be made on renewal, use the current application’s separate-filing instruction. Accurately disclose the situation and identify any pending change application; do not assume listing a new owner or DBA approves the change. [1] [3]

Is a certificate of occupancy routinely required again?

ABC Law § 109 contains certificate-of-occupancy language, but SLA Advisory 2022-15 expressly removes the routine submission requirement for a license application and the former requirement to supply the document by the first renewal. It also removes routine submission of a public assembly permit for licensed-premises applications. An older waiver form promising submission at first renewal should be read in light of that later advisory. [6] [14]

This is an agency document-submission policy, not an exemption from building, fire, zoning, health, or assembly requirements. The advisory preserves those obligations and identifies 9 NYCRR § 48.3 as a disciplinary basis for on-premises violations of local codes. Keep the business’s underlying approvals in order and respond to any specific agency request on its terms. [14]

How much does renewal cost?

Use the total shown on the business’s own renewal advisory. The amount depends on the license class, location, term, and applicable ancillary charges. A chart for new applications can include a different filing fee; copying that chart’s total is not a reliable way to calculate a renewal payment. [5] [8]

The SLA’s published November 2026 retail renewal advisories provide these examples:

Published renewal example Term and fee calculation
Manhattan restaurant-liquor license November 1, 2026–October 31, 2028: $4,352 license fee + $90 filing fee + $0 ancillary fee = $4,442
Queens grocery beer-and-wine-products license November 1, 2026–October 31, 2029: $594 license fee + $30 filing fee + $0 ancillary fee = $624

These are examples from actual agency advisories, not universal quotes for every restaurant or grocery. Additional privileges or a different location or class can change the bill. The figures also exclude the surety company’s bond premium, postage, and any professional fees. A bond’s face amount is not the same thing as the premium paid to obtain it. [5] [12]

If the mailed advisory is missing, search the SLA’s online Renewal Advisory Letters by the business name or license ID and print only the relevant pages. Combined craft, multi-license, and master-file renewals are not posted there. Coordinate with the person handling the application so the owner and representative do not submit duplicate checks and packets. [15]

Where and how should the application be filed?

The current retail application directs mailing to:

M&T Bank Lockbox

New York State Liquor Authority

PO Box 8000-Dept 930

Buffalo, New York 14267

The SLA warns that applications mailed elsewhere will be returned and delayed. Use a delivery method compatible with the stated destination. An emailed question, a downloaded advisory, or an electronic-signature checkbox on a form does not establish that the renewal itself was filed through an authorized online channel. Follow the current submission instructions and preserve a complete copy of the packet. [1] [3]

Before mailing, compare the advisory’s license ID, the application, the bond, the notice where applicable, and the payment. Have one person confirm the packet is complete and another check the identifiers and signatures if the business has staff available. After mailing, record the tracking result and watch the application’s designated email and mailing address for correspondence.

The SLA asks applicants to allow ten business days for processing. That is planning guidance, not a guaranteed decision date and not an extension of the filing deadline. Submit substantially earlier where a notice issue, disclosed criminal matter, safekeeping question, or business change needs attention. [3]

Can the business keep operating while renewal is pending?

SAPA § 401(2) preserves an existing license when a licensee has made a timely and sufficient renewal application for an activity of a continuing nature. The SLA’s Advisory 2022-33 applies the seven-calendar-day filing rule and treats an incomplete application as insufficient. If a timely applicant cures a deficiency before the existing license expires, the advisory permits SAPA operation when a decision cannot be made before expiration. [4] [2]

Consider two examples:

  • Timely filing with a corrected defect: A business files three weeks before expiration, learns that the bond lacks its signature, and supplies the correction before expiration. The timing and cure can satisfy the advisory’s requirements; preserve the evidence and establish the resulting status with the agency.
  • Complete but late filing: A business sends a complete packet two days before expiration. Filing before the certificate’s last day does not satisfy the SLA’s seven-day rule and does not secure SAPA protection under that rule. The business needs an approved renewal or other actual lawful authority for alcohol operations after expiration. [2]

A valid summary suspension remains effective notwithstanding a renewal application. If a timely and sufficient renewal is denied or limited, § 401(2) also addresses continued effectiveness through the last day to seek review, or a later date fixed by the reviewing court. Do not assume a lawsuit by itself extends the license indefinitely. For a denial or uncertain status, obtain a precise determination of the applicable operating period and any court order. [4]

Pending disciplinary charges do not, under Advisory 2022-33, require the SLA to leave the renewal undecided until those charges conclude. Renewal also does not erase the charges or prevent later discipline. The advisory similarly distinguishes pending criminal charges from a failure to disclose a required arrest. [2]

What notices and records are needed after filing?

For liquor-license renewals under the sections listed in ABC Law § 100(9)—§§ 64, 64-a, 64-b, 64-c, 64-d, and 64-e—the applicant must post the prescribed conspicuous pink entrance notice within ten days after filing and make reasonable efforts to keep it posted while the application is pending. Reposting is required within ten days after receiving an SLA written request. This is separate from community-board service and is not a universal requirement for every off-premises or beer-only renewal. [16]

Routine renewal does not require repeating the newspaper publication applicable to an original license application: § 110-a(4) limits that publication section to original applications. Other pending applications or specifically directed notices must be considered separately. [17]

Keep the application, advisory, bond copy, check record, service evidence, mailing documentation, deficiency responses, and agency correspondence together. When the new certificate arrives, verify the licensee, premises, class, term, and any conditions before treating the matter as finished. Preserve the old records even after replacing the displayed certificate.

What if the renewal is already late?

Submit the applicable late-renewal requirements form with the renewal packet. It asks why the filing is late, whether alcohol was purchased after expiration, whether there were unlicensed-sale or service summonses, and whether the premises remained open. Answer accurately and retain the supporting records. The form’s instruction to email a requested supplement after a packet has already been mailed is not permission to file the entire initial renewal by email. [18]

A late application or accepted payment does not itself authorize continued alcohol sales. If the license has expired without SAPA protection or an approved renewal, stop the alcohol operations requiring that license and address the renewal and any resulting enforcement issue promptly. How should an owner prepare the next renewal?

Set reminders well before expiration, serve any required community-board notice early, order the bond for the correct new term, and set an internal filing target ahead of the seven-day deadline. Assign responsibility for monitoring correspondence and closing out deficiencies. The practical objective is a complete, traceable filing with a documented operating status through issuance of the new certificate.

Rodriguez Law can assist with renewal preparation, notice and service issues, required disclosures, and coordination of a renewal with pending business changes or SLA proceedings.
