Cannabis Licensing
New York Cannabis Licensing refers to the process of obtaining a license to operate a cannabis-related business in the state of New York. On March 31, 2021, New York Governor Andrew Cuomo signed the Marijuana Regulation and Taxation Act (MRTA) into law, legalizing adult-use cannabis in the state.
The MRTA creates a framework for the production, distribution, and sale of cannabis products, and establishes licensing requirements for businesses in the industry. Under the law, the New York State Cannabis Control Board will oversee the licensing process and regulate the industry.
The licensing process will be open to a wide range of businesses, including cultivators, processors, distributors, retailers, and delivery services. There will also be opportunities for social equity applicants, which are defined as individuals from communities disproportionately impacted by the enforcement of cannabis prohibition.
Retail Dispensary
The New York cannabis dispensary license is a type of license that allows businesses to legally operate a cannabis dispensary in the state of New York. This license is required by the state in order to sell and distribute cannabis products, including medical marijuana and adult-use cannabis.
Under the new cannabis laws in New York, the state will issue licenses for dispensaries to sell cannabis to adults for recreational use. The licenses will be available to social equity applicants, as well as existing medical marijuana operators.

Delivery
The New York Cannabis Delivery License is a type of license that allows businesses to deliver cannabis products directly to consumers in the state of New York. Microbusiness
The New York Cannabis microbusiness license is a type of license that will be available under the state’s recently legalized adult-use cannabis program. Under the microbusiness license, businesses will be able to grow up to 1,500 square feet of cannabis plants, process cannabis products, and sell them at retail locations or directly to consumers. This license is intended to create opportunities for small businesses and individuals from communities that have been disproportionately affected by cannabis prohibition to participate in the new legal cannabis market.
To qualify for the microbusiness license, applicants must be residents of New York, and the majority ownership of the business must be held by individuals who have lived in areas disproportionately affected by past drug policies or have been convicted of a cannabis-related offense. The application process for the microbusiness license is expected to begin in 2023.
Testing Laboratory
The New York Cannabis Testing Laboratory License is a license issued by the New York State Department of Health (NYSDOH) to laboratories that conduct testing on cannabis and cannabis-derived products.
Under New York’s Cannabis Regulation and Taxation Act (CRTA), which was signed into law on March 31, 2021, all cannabis products sold in the state must undergo testing by a licensed laboratory. This is to ensure that the products are safe for consumption and accurately labeled.
To obtain a New York Cannabis Testing Laboratory License, laboratories must meet certain requirements set by the NYSDOH, including:
- Accreditation: Laboratories must be accredited by an accrediting body recognized by the NYSDOH, such as the International Organization for Standardization (ISO).
- Personnel: Laboratories must have personnel who are qualified to perform the required tests and have completed the necessary training.
- Equipment: Laboratories must have equipment that meets the standards set by the NYSDOH for cannabis testing.
- Standard Operating Procedures (SOPs): Laboratories must have written SOPs for all aspects of their operations, including sample preparation, testing procedures, data analysis, and reporting.
Once a laboratory has obtained a New York Cannabis Testing Laboratory License, it must adhere to the regulations and standards set by the NYSDOH for cannabis testing. The laboratory must also undergo periodic inspections to ensure that it continues to meet the requirements for licensing.
Distributor
A cannabis distributor license in New York would allow the holder to legally purchase cannabis products from licensed producers and processors and then sell and distribute those products to licensed retail dispensaries. Distributors will be responsible for ensuring that products meet all state-mandated testing and labeling requirements, and that they are transported securely and tracked through the supply chain.
